House or flat Sale

Whether you are selling up and moving on, or selling and buying a new property, it is important for everything to dealt with properly.

The solicitors will obtain details of the whereabouts of your deeds, obtain them, and once the sale is agreed, send a draft contract and supporting papers to your buyer's solicitors. You will be asked to answer questions concerning the property and to provide a list of fixtures to be left, but the solicitor will be happy to help you with these issues and to clarify any questions raised so you can answer them to the best of your knowledge.

The solicitor will ensure the sale exchanges and completes at the same time as any related purchases you have.

The solicitor will liaise with your agents and pay their fees if you so wish out of the proceeds of sale. The solicitor will also ensure your mortgage is repaid and evidence of this is obtained.

Purchase freehold or leasehold

You will need the legal title to the property checked as well as any issues affecting the property. Our solicitors will do this and ensure that a fair contract is agreed for you to sign once you are ready to proceed. Our solicitors will arrange for the necessary papers to be prepared for completion to take place and register your ownership of the property at the Land Registry.

Our solicitors will liaise with the agents for the seller to keep them informed of progress to help give both you and the agents the ability to find out the up-to-date situation whenever you need to. Where the purchase is part of a chain transaction as you are selling as well our solicitors can also liaise with the buyer's solicitors and your agents to ensure everyone is working to the same timetable.

Mortgages

You may be taking a mortgage for the first time or wishing to maximise the equity in your house or flat and therefore taking a higher mortgage to pay for a holiday, car, or improvements to your property.

Our solicitors are aware that you will want to obtain the funds as quickly as possible with as little inconvenience as possible and will assist with the necessary paperwork.

Although our solicitors will not need to deal with another solicitor, they will need to check the deeds and obtain searches to satisfy the lender that the property is good security and will therefore deal will all aspects of this. Our solicitors will also advise you on the terms of the mortgage deed.

Right to Buy

If you have been offered the "right to buy" by your council or housing association landlord, you will probably have been inundated with papers that do not make sense. You may be dealing with the purchase of a property for the first time and find the process confusing or difficult.

Where you are taking advantage of a right to buy you will be offered a discount by the Council which means you can take advantage of a lower purchase price. However, the Council or Housing Association does have the right to have some of the discount repaid should you sell the property within a certain time after your purchase and our solicitors will advise you on the consequences of this.

Where you are buying a leasehold property from the council or housing association you will not be a "tenant" anymore, but will still have to pay rent and other charges. You will also have a form of lease from the council and our solicitors will explain this to you to ensure it is all very clear.
